Los Angeles sex crime criminal lawyers almost all have a horrible story to tell of a sexually abusive parent who goes too far with his children. While everyone deserves a strong criminal defense and while everyone in America is innocent until proven guilty, the details of a sex abuse case involving a child and its parent is disturbing. A recent case involving a musical family is no different, and has the general public in extreme disgust. It is cases like these where an experienced lawyer can truly earn his pay check. Providing a man accused of sexually abusing his own children a great defense is not just difficult, it is next to impossible. However, qualified lawyers are prepared to face even the most biased juries, the most difficult judges and prosecutors who are incredibly motivated to put their client behind bars.
A recent sex crime case involves five siblings known as "The 5 Browns." They are a classical piano group that has played throughout the world and each one was trained at Julliard's school of music. The allegations involved sexual abuse of his three daughters between 1990 and 1998 when they were minors. The father, Keith Scott Brown was charged with one count of first degree felony sodomy upon a child and two counts of second degree felony sexual abuse of a child. He was charged on February 10, 2011 and was involved in an accident, crashing his car and falling down a 300 foot cliff with his wife on Valentine's Day. While in critical condition, he pleaded guilty and could be facing 10 years to life in prison. While he may strike a deal for the sentences to run concurrently, it is possible that he could be in jail for the rest of his life.
A skilled Defense Attorney understands that charges such as these involve horrible family secrets. Yet, a lawyer must be on the side of his client no matter how severe the allegations are. In many cases, family members and others are not telling the full truth, or are lying about the events because it gets them attention. While that does not appear to be teh case in this instance, it has been the case in many other sex crime cases. A skilled lawyer can sift through the false allegations and provide their client with the necessary legal representation to keep them out of prison and free from fines.

Throughout the city lately, Los Angeles White Collar Defense Lawyers are working overtime, defending people from a variety of criminal charges ranging from embezzlement to money laundering. A recent case in Van Nuys highlights how white collar charges can even impact those who work in the criminal law industry. A Van Nuys woman who worked as a bail bonds agent was in court on a felony count of grand theft by embezzlement. The woman is 55 years old and was taken into custody earlier this month; she faces a maximum of three years in prison if she's convicted. She allegedly stole from clients in order to use these funds personally. According to authorities, from February through April 2009 she executed 13 American Surety Co. bail bonds worth almost $400,000. She is accused of collecting at least $34,000 in gross premiums from 12 of the 13 defendants that she bailed out, but failed to repay over $5,000 in net premiums due to the Bail Bond company. The investigation also uncovered other alleged crimes, including failing to return or account for 11 bail bonds with a face value of $250,000 and worth $3,250 in premiums.
Investigators learned of the alleged embezzlement scheme last may and forced the woman to give up her license. Embezzlement is the act of dishonestly appropriating (stealing) assets by one or more individuals to whom such assets have been entrusted. Any white collar crime charge involves mountains of paperwork, bank statements, electronic transfer notices and much more. The government is trying to prove that the alleged criminal used money illegally, didn't pay taxes and didn't pay the people they were supposed to pay. Unlike a crime such as stealing a car or breaking into someone's house to steal their television, there are no finger prints or witnesses to a white collar theft crime. The government must build its case through paperwork and investigation.
If you or someone you know has been arrested for or accused of a white collar crime in Los Angeles, contact a qualified lawyer today at Kestenbaum Eisner & Gorin. We know how best to craft a defense. We use the best experts in the field of investigations, expert witnesses and accounting in order to build your case.

No one is more aware of the need for a good LA criminal attorney than former porn star Janine Lindemulder. At one point, "Janine" was quite famous, gracing the cover of a 311 album, and considered one of the hottest porn stars in the late 90's and early 2000's. However, her life has fallen apart a bit recently, stemming from a former marriage to Jesse James. Yes, that Jesse James, the one who cheated on Sandra Bullock. Janine was arrested in Austin, TX on a warrant for harassing Mr. James in a series of allegedly abusive phone messages. Janine, who has had quite a bit of legal trouble stemming from her relationship with James and their children, had three warrants issued for her arrest after Jesse James turned over allegedly threatening voicemail messages he says Janine left for him. According to the legal documents, Janine places harassing telephone calls to him at all hours of the day and night. In fact, James claims to have received 300 calls since he moved to Texas. The calls apparently became so harassing and abusive that he felt the need to turn them over to the police.
Janine's long history with the law is impacting her ability to see her children, as well as her overall freedoms. She has called upon the assistance of a lawyer many times, after arrests for harassment, assault, drug use and much more. In this most recent case, she was charged with three counts of misdemeanor harassment and bail was set at $6,000. Further complications of this sort could lead to her missing time with her daughter, mandatory prison time and further loss of freedoms. For example, if Jesse James takes out a restraining order that involves phone calls, she could face severe punishment for harassing phone calls. The divorce from James complicates matters quite a bit.
If you or someone you love has been arrested, you need a qualified defense attorney. Contact the lawyers at Kestenbaum Eisner & Gorin, LLP today to learn how we can help you. Three types of sex crimes seem to be prosecuted in a more severe way than all others: sex crimes against children; sex crimes against the elderly; and sex crimes against the disabled. Increased jail time, less sympathy from a jury or judge and years spent on the Sex Offender list are all very real punishments in such a case. A recent case in El Monte highlights just how terrible such a crime is, and just how harshly the general public will perceive anyone involved in a sex crime.
A former employee of an adult day care center pleaded no contest to sexually assaulting three severely disabled women with the mental capacity of children. The plea deal came in exchange for an agreement with prosecutors that he be sentenced to no more than eight years in prison. While eight years is better than fifteen, that is still almost a decade in prison. The 43 year old man actually faced up to 27 years if he had been convicted on all charges, which included multiple assaults and transmission of sexual disease. Each of the victims in this case had severe mental disabilities, including Down's Syndrome, and range in age from 24 to 54.
While there was no comment from the man's Los Angeles defense lawyer, it is obvious the lawyer was working hard behind the scenes. To get a sentence reduced by 19 years is pretty dramatic, and even though eight years is a long time, he will be relatively young when he emerges from prison. Under the terms of the deal, the man will have to serve 85 percent of the sentence and will have to register as a sex offender upon release. One of the worst consequences of being convicted with a sex crime is having to register as a sex offender. Anyone on that list will face limited career options, limited living options and public shame.

A horrible tragedy occurred recently, highlighting why it is so important to have a Los Angeles Sex Crime Defense Attorney working hard on your behalf to keep you out of prison. A registered sex offender was murdered by his cellmate while serving a 30 year sentence for sexually molesting a girl in 2008. It is widely known that sex offenders are easy prey in prison, as inmates and even guards go out of their way to continue any punishment they feel fits the crime. This means that more than just freedom is on the line for anyone charged with a sex offense. When a Los Angeles Sex Crime Defense Attorney represents someone facing serious sex crime accusations, he understands the dangers that individual will face if he or she is thrown in jail.
In this case, Jaime Elizondo was found dead in his jail cell at High Desert State Prison in Susanville in December 2010. It appeared that there were "suspicious circumstances" according to Lt. Charles Hahn. An investigation is under way to find out exactly what happened. The prime suspect in the case is Steven Cisneros who has been placed in the prison's administrative segregation unit pending the investigation. Elizondo was put in jail in September after being convicted of "lewd and lascivious acts on a child under 14 with prior felony convictions." He had exposed himself to a girl inside an Arcadia bookstore before the most recent conviction. He arrived int he prison on November 30, the same day his alleged attacker arrived. Cisneros was serving a sentence of 56 years to life for murder with prior felony convictions. The District Attorney is investigating the crime as well and various other legal bodies are lending a hand.
As you can see, being a sex offender in prison can make you a target to other prisoners. The punishment never seems to end for anyone charged with a sex crime. The general public considers sex offenders as lower than dirt, the courts have increasingly harsh sentences, and even fellow convicts and criminals judge them guilty. Without a skilled Los Angeles Sex Crime Defense Attorney working for you, you could be all alone and facing a lifetime of cruel and unusual punishment. If you have been charged with, arrested for or accused of a sex crime, contact Kestenbaum Eisner & Gorin, LLP by calling 877-781-1570. In South Los Angeles a day care center operator has been accused of lewd acts with a 13 year old. The woman is accused of having sex with her teenage godson in a van. Chelsea Nichole McClelland was arrested near the Santa Monica Freeway and La Brea Avenue and is charged with suspicion of multiple instances of lewd acts with a child. She is being held in lieu of $400,000 bail in Van Nuys. She operated a day care center out of her home according to the Los Angeles Police Department. When resident reported seeing a van parked in the Mid-City area, a boy was found inside and he told them he was 18. However, after the LAPD sex crime detectives interviewed him, he acknowledged he was only 13. Some of the lewd acts took place allegedly when the boy was only 12 years old. The woman has three biological children of her own and is the legal guardian of a fourth.
In another case that required a Los Angeles Sex Crime Attorney, a man who taught school in Cambodia was sentenced to nearly nine years in Los Angeles to a federal prison for traveling abroad to have sex with a 14 year old girl. The 61 year old man was sentenced to 104 months in jail and was ordered to pay nearly $10,000 in restitution to the victim. The man pleaded guilty in September as part of a plea agreement to one count of engaging in illicit sexual conduct with a minor in Cambodia. He had a sexual relationship with the girl for five months in 2008 while he was teaching there at a private school. He actually had a "financial arrangement" with the girl's family and gave them food and about $200 a month .

Los Angeles Criminal Defense Lawyers witnessed two amazing pieces of news this month, one involving a major criminal trial, another involving the death of a man who was pursued by police.
In Fullerton, a city just south of Los Angeles, saw a man get sentenced to 110 years to life in state prison for murdering his neighbor when he found her in bed with his adult son. Guillermo Rodriguez was found guilty by a jury of one felony count of murder, of criminal threats and of dissuading a witness from testifying. Previously, the man had four convictions, including two for robbery and two for assault with a deadly weapon. On the night in question, he had a dinner party at his apartment. Around one in the morning, Rodriguez went out to purchase more alcohol and when he returned, he walked into the bedroom to find his 18 year old son in bed with a 42 year old neighbor. After sending his son and his girlfriend out of the room, Rodriguez allegedly strangled the 42 year old woman, wrapped her in a blanket and buried her in Victorville with his son. The body was later found by hunters who contacted police. The man's son pleaded guilty to being an accessory after the fact and was sentenced to one year in jail and three years' probation.
In Long Beach, a man was shot and killed Sunday by Long Beach police. The man was suspected of sexually assaulting a family member. Officers allege that their car was flagged down early in the morning by a woman who claimed the sexual assault of a female minor had just happened. After taking to the alleged victim, officers went to the suspect's residence. Police then say the man produced a handgun at which point the officers fired on him. He was pronounced dead on the scene.
These are the two worst case scenarios for anyone charged with a crime. This man may have been innocent and quite possibly had no clue why police were approaching his home. Many individuals distrust police, especially if they have a prior criminal record. However, firing on police is quite possibly the stupidest and most dangerous thing a defendant can do. Beyond the fact that you could kill an officer of the law, the officer's will fire back and the best case scenario is that you'll have another charge to deal with. The worst case scenario is that you will be killed.

Los Angeles Criminal Defense Attorneys who represent people charged with possession, distribution or creation of child pornography know that the law enforcement challenges are numerous. Police, Sheriff's deputies and even FBI agents are involved in trying to bring child pornographers to justice, meaning that any Attorney not only has to battle the best lawyers the government has, but the best law enforcement officers as well. A recent case demonstrates just how effective and efficient government child porn busts can be. An international child pornography ring that covered three different continents and required members to post explicit images on a secure Internet message board was dismantled and arrests of a dozen people or more has ensued. This international investigation led to the closure of what was known as the "Lost Boy" bulletin board and suspects from Germany to New Zealand were identified. Allegedly 35 men traded and posted pictures of young boys who were either naked or engaging in unlawful sex.
The people who are implicated in this criminal activity are from a broad array backgrounds. One was a pediatrician, one was a lawyer and several were already registered sex offenders. According to authorities, a man from Los Angeles had been talking to an Italian national about child pornography and how to engage in child sex tourism in Romania. This is what tipped off European authorities to contact authorities in the United States. International search warrants were served at home and abroad with 16 people being arrested and charged with child pornography. Five men have pleaded guilty so far and face between five and thirty years in a federal prison. Other suspects have been charged in Brazil, in France, in Norway and the United Kingdom. As you can see, these are highly sophisticated investigations that get results and battling these allegations in court is incredibly difficult without a skilled attorney working for you.
If you or someone you know has been charged with or arrested for child pornography, you need a skilled Defense Lawyer who understands federal courts and lawyers. It might be a parent's worst nightmare, but a town in Nebraska recently had a Santa Claus who was caught allegedly possessing child pornography. Daniel Davis pleaded not guilty in North Platte, NE to eight counts of possession of child pornography. Investigators say they found a Santa suit in Davis' home of the 57 year old man, although it was not immediately known if he was working as a Santa around town. Police allege they found still photos and video images of children in pornographic situations on the man's computer. There is a trial set for March 15, and each of the child porn counts carries a maximum of five years in prison (that's 40 years total for those counting at home).
Any Los Angeles Criminal Defense Lawyer will tell you that defending someone facing child pornography charges is incredibly difficult. Even the most skilled attorney has to combat the law, motivated district attorneys, biased juries and even the press if they get wind of the case. For a 57 year old man, a 40 years sentence is essentially a death sentence. While the general public may have already put this man in prison for crimes he is only accused of, a Attorney knows that his client deserves the same unbiased justice system as everyone else.
It is also important to remember that computer files are a tricky thing. If you were to buy a computer, it might already have illegal images or information on it. Or, if you were to download a file from the Internet, you could be downloading something that is not what you think it is. Only a skilled, experienced Defense Attorney can analyze your case and build the best defense possible to whatever allegations the prosecution are armed with.
Kestenbaum Eisner & Gorin, LLP possess the knowledge, background and track record of success people look for. It is a grim day whenever a person goes away for a violent crime, and many Los Angeles Criminal Defense Attorneys work overtime to make sure that never happens to their client. However, in one case this week, a celebrity chef is going to be spending years behind bars for a violent crime in Los Angeles. Former "Calorie Commando" chef Juan-Carlos Cruz is going to spend up to nine years in prison on a charge of soliciting two homeless men to murder his wife. Such a bizarre crime is odd, even by Los Angeles standards, but has been taken quite seriously by the Los Angeles Superior Court. Cruz pleaded no contest to the crime earlier this year and smiled and winked at wife Jennifer Campbell during his sentencing appearance. Cruz's lawyer said that Cruz will serve half of the nine year term because the crime was not a serious violent felony. Police initially arrested Cruz in May after some homeless men in Santa Monica told police they were offered $500 to kill Campbell. Prosecutors have not released any sort of motive int eh case and both Campbell and the Judge, Shawn Chapman Holley, have refused comment on the case.
While this case is incredibly unique, criminal courts in Los Angeles take any sort of violent crime seriously. Cruz is a celebrity, but still faces the full wrath of the law due to the murder charges. While in the past, celebrities have been able to avoid prosecution for certain offenses, it seems the tide is turning. Such celebrities as Phil Spector and DMX have spent quite a bit of time in prison lately because prosecutors are really focusing their attention on avoiding weak sentences for celebrities caught by the law. Even professional athletes who normally get off without so much as a slap on the wrist have been prosecuted and scrutinized heavily by the press and the courts.
For those facing arrest or conviction for violent crimes, having a knowledgeable and skilled Defense Attorney working with you can be the difference between years in prison and complete freedom. Having a lawyer who understands the law, the courts and how to properly create the best defense possible is absolutely vital. Violent crimes can lead to decades in jail, years of probation, mandatory counseling and limited career options if you are convicted.
