Paris Hilton and Drug Crimes

As most people know by now, Paris Hilton will be charged with possession of a controlled substance due to her arrest in Las Vegas. Observers of this incident, including her Los Angeles Criminal Defense Attorney are pleading with the public to keep an open mind about the incident because "arrested" does not mean "guilty" or "convicted." This particular drug charge is a felony, and the controlled substance in question is cocaine. According to the police report, a police officer pulled over Paris Hilton in an Escalade and smelled the odor of marijuana coming from the vehicle. When Paris Hilton asked to use the restroom over the course of her arrest, opened up her purse and the officer "saw a small bindle of what [he] believed to be cocaine in a clear baggie begin to fall from the purse and into [his] hand." The arresting officer also says the purse contained a broken tablet of Albuterol, which is a prescription drug used to control wheezing. This is a question that I haven't had a solid answer for a long time. Although I'm a , this question seems to dumbfound a lot of lawyers that I asked.
