Former Trojan Charged with Los Angeles Drug Crime

Posted on: May 26, 2010 at 6:08 p.m.

Kevin Ellison, current San Diego Charger and former USC Trojan, was pulled over and arrested in Redondo Beach for possession of prescription drugs. Ellison was arrested for a Drug Crime when an officer found dozens of Vicodin tablets in his car. He was initially pulled over for speeding in a school zone where he consented to the search of his car. Inside the vehicle, police found roughly 100 Vicodin pills, which allegedly far exceeds any amount a doctor would prescribe. Ellison was actually charged with was suspicion of possession of a controlled substance. He was released on $10,000 bail. Ellison was a standout on defense at USC where he played for four seasons. He started nine games as a rookie for the San Diego Chargers, making 59 tackles. He is currently 23 years old.

Many Drug Crimes involve such unlawful narcotics as heroin, LSD, cocaine, crack and marijuana. However, there is a growing emphasis on such prescription pharmaceuticals as Vicodin, OxcyContin and others. The penalties include imprisonment, large fines, restitution, community service, probation and more. If you are in possession of a large amount of drugs, whether lawful pharmaceuticals or unlawful narcotics, you could be charged with “intent to distribute." Many distribution crimes are felonies, leading to mandatory jail sentences and other serious penalties.

With such life altering penalties involved in any Drug charge, only a skilled Los Angeles criminal defense lawyer can be hired. A skilled lawyer will know the law, the courts and how to craft the best defense possible for anyone charged with a drug offense. Penalties are severe, and with the state’s need for larger revenue, he fines could quickly increase and create a financial burden upon the convicted.

At Kestenbaum Eisner & Gorin, we can provide the kind of legal representation necessary to steer clear of penalties and fines. If you or someone you love has been charged with, arrested for or accused of a Los Angeles Drug Crime, contact Kestenbaum, Eisner & Gorin, LLP who will contest their criminal charges and obtain superior results for years.

Los Angeles Drug Crimes - Not Just For Illegal Drugs

Posted on: April 7, 2010 at 9:09 p.m.

Whenever someone reads in a newspaper or website that someone was arrested for a Los Angeles Drug Crime, they usually think of such illegal drugs as crack, marijuana, heroine or some other illegal narcotic. However, a growing area of drug law in the city is pharmaceuticals, and lawyers are spending more and more time defending people charged with possession and distribution of such "drugs."

A recent, high profile example of someone involve in a Drug Crime that involved prescription medications is recently deceased actor Corey Haim, who allegedly died due to an overdose of pharmaceutical drugs. Haim obtained at least 553 pills of powerful prescription drugs from seven different doctors, and as many pharmacies, according to a recent investigation. Few would think that a doctor could be arrested, but obviously this story may mean that doctors will have to pay close attention to the drugs their patents are ingesting.

In this alleged Crime, investigators stated that Haim obtained almost 200 tablets of Valium, almost 200 tablets of Soma and almost 150 tablets of Vicodin, as well as some Xanax. Each of these pills is powerful enough on its own, let alone taken in great quantities, and/or taken in conjunction with other pills. The state of California is examining as many as 5,000 illegal prescriptions throughout California, bringing legal drugs charges.

For Defense Attorneys, this may mean representing doctors in Drug Crime trials. Perfectly respectable professionals with strong track records of treating patients could be charged if it is thought they contributed to the death of a patient due to negligence or poor follow up. A doctor could be held liable for treating someone's illness if they prescribe a prescription drug.

If you or someone you know has been charged with a Drug Crime, contact Kestenbaum, Eisner & Gorin. We have years of experience defending individuals charged with drug crimes in Los Angeles, San Fernando Valley, Hollywood, Van Nuys and throughout Southern California.

Los Angeles Drug Crimes Will Change Radically

Posted on: March 19, 2010 at 12:14 a.m.

Any Los Angeles Drug Crime Defense Attorney will tell you that the sentencing standards in drug offense cases are the cause of more pain and heartache than almost any other area of criminal law. Between the Three Strikes Law in California and the general disdain for drugs in the city, Attorney teams work double time to prevent their clients from going to jail for even minor infractions.

The United States Senate passed a bill years ago that created a huge disparity between the sentencing standards of cocaine infractions and crack infractions. As drug crimes go, in the past, the ratio of sentencing was 100-1, cocaine to crack. This means that 100 ounces of cocaine was equal to 1 ounce of crack in terms of sentencing. The Senate changed all of that, reducing the ratio to 18-1.

While this may not seem like a big deal, any Defense Attorney will admit that this will partially lift a huge burden carried by the black community. African Americans were punished in a far more severe way for possessing crack than a white person would be for possessing cocaine. The law was racist, punishing minorities, simply because they could not afford the more affluent drug of cocaine.

African American and other minority communities are often unduly punished by state and federal drug laws, facing excessive fines, jail time and probation for Los Angeles Drug Crimes. The state of California has zero tolerance when it comes to drug related offenses. All drug crimes are taken seriously by law enforcement and prosecuted to the fullest extent. Commonly committed drug crimes include: drug possession, drug possession with intent to sell, possession of drug paraphernalia, drug manufacturing, drug trafficking, drug distribution, drug cultivation, and money laundering.

Los Angeles Marijuana Facility Found in Woodland Hills

Posted on: March 17, 2010 at 6:15 p.m.

When a Los Angeles Drug Crime Lawyer defends someone accused of a drug offense, they are fighting more than just the law. Anyone accused of, or charged with, a drug offense leads to being viewed as a pariah, as if only truly devious people can be caught up in a drug charge. Every Attorney understands that countless respected professionals, high profile celebrities, prominent politicians and professional athletes have been arrested for, or spent time in jail for, drug crimes.

In this particular drug offense situation, a man was arrested for having 50 marijuana plants in his Woodland Hills home. To make matters more interesting, these marijuana plants were found because the man was attacked and called the police over the break in. He was beaten and robbed by two men in their 20's, and while police were investigating the incident, they found the marijuana plants.

One possible area a Defense Attorney could focus on in such a case is the way in which the police investigated the crime and searched the premises. For example, there are specific guidelines the LAPD must follow when looking over a crime scene. If they overstep their bounds, a skilled Los Angeles Criminal Defense Attorney could prove that the search was illegal.

Kestenbaum, Eisner & Gorin, LLP is a criminal defense law firm that has been helping clients throughout Southern California contest their criminal charges and obtain superior results for years. Our skilled drug crimes attorneys have over 50 years of collective court room experience and we are fully prepared to undertake our clients’ cases. When we work with our clients, we do everything possible to make sure that they receive the attention, resources, and dedicated legal counsel that they deserve.

‘The Outsiders’ Actor, Leif Garrett, Arrested For Los Angeles Drug Crime - Possession Of Heroin

Posted on: February 20, 2010 at 2:23 a.m.

The amount of drugs in the city of Los Angeles is unbelievable. Whether movie stars or house moms, Los Angeles drug crimes lawyers represent people in all walks of life.

Leif Garrett, the former 1970s teen idol, was arrested late Monday after allegedly carrying heroin into a Los Angeles Metrolink subway station. The singer and actor, who has been featured in tons of films, soundtracks and television shows, was released on bond Wednesday, according to Los Angeles County sheriff's spokesman Steve Whitmore.

The 48-year-old former child star was shaking and sweating at the time of his arrest, according to Whitmore. Garrett denied having drugs at first and allowed them to search him, then admitted that he had black tar heroin in his shoe, said Whitmore.

This is not Garrett’s first encounter with the law or drug use. In 2006, Garrett was arrested at another Los Angeles subway stop for having heroin.

In 2006, he was sentenced to 90 days in jail and three years of probation after opting out of a drug treatment program.

Garrett appeared in films including 1983's The Outsiders, alongside big names such as Rob Lowe, Emilio Estevez and Tom Cruise.

A spokeswoman for Garrett did not comment.

The actor is due back in court Feb. 24. It was not immediately clear if Garrett had a defense attorney.

A Los Angeles drug offense, however small, can be terrifying and can carry serious penalties if the accused is convicted. These penalties can include drug treatment programs, fines, probation, community service and even jail time. Even a small amount of drugs in a drug possession case can land someone in jail if the circumstances allow.

A dedicated and professional drug defense attorney team at Kestenbaum, Eisner & Gorin, LLP will work on your behalf to negotiate with police and prosecutors.

We will make sure that the case is valid and that your constitutional rights were not violated when the arrest was made. We will also devise a plan that might be able to have your charges reduced from a felony to a misdemeanor or infraction depending on the circumstances surrounding the case.

Los Angeles Drug Crimes 2

Posted on: December 31, 2009 at 6:40 a.m.

When a Los Angeles drug crimes defense attorney represents someone accused of possessing, trafficking or using drugs, they must be a highly qualified lawyer. This includes possession, sales, trafficking and more, and only a skilled criminal defense attorney can keep anyone accused of such a crime free from prison.

One such person is a church leader accused of a Riverside drug crime. A man was arrested on suspicion of selling drugs out of his church in Riverside, having previously been shot during a burglary attempt. In addition to drug crimes, the man is accused of sexual crimes as well and is being investigated by police. In September of this year, the man was wounded in a shooting during a robbery attempt outside his church, authorities said. He was taken to a local hospital, where he recovered. At the time, he reported to police that he had encountered four juveniles when he was shot. The man, who calls himself a bishop, and his church are not affiliated with the Roman Catholic Church.

If the man is found to have been running drugs out of his church, public opinion about him will very low, and any jury trial will be extremely difficult to defend. In addition, any drug crimes defense involves financial records that could lead to tax fraud charges by government lawyers.

In such a high profile case, an experienced attorney is absolutely necessary. A drug crime such as sales or trafficking can lead to years of prison, and may even be a federal crime if any interstate trafficking and/or sales was involved. Federal crimes are that much more difficult to defend. A Los Angeles drug crimes defense attorney can make sure that anyone charged with a drug crime gets the representation they need to protect their rights and freedoms.

If you have been charged with a serious criminal offense, do not hesitate to call Kestenbaum, Eisner & Gorin, LLP to evaluate your case and advise you of your legal options.
